Postponed session makes for light county planning and zoning agenda

The county Planning and Zoning Commission has a light agenda on Wednesday with the recommended postponement of the work session on the amended hazard abatement ordinance.

Planning and zoning department staff have not completed adding changes and explanations for the changes as requested by the commissioners back in December. The new date for the work session has been set for April 14.

The only business matter the commissioners will be discussing is an application for a special use permit for a dog breeding and kennel facility as requested by Marian Beal (also known as Lindenmayer), who lives in an RU-4 (single family home on a minimum of four acres) near Benson on Appaloosa Lane. She wants to breed 10 dogs, hold 15 "retired," non-breeding dogs as pets and construct a 720-square-foot structure that would house a sick bay, a cleaning and grooming room, a whelping pen and six dog runs. The building would be phased in over two years.


It's Beal's second try for the permit. Two years ago she was denied the permit when she wanted to house 50 dogs, but complaints of noise from neighbors were heard by the commissioners and her request was denied.

Now, she states in documentation provided by the department that she wants a scaled-down facility with only 25 dogs.

Planner Michael Turisk notes in his summary that the proposed development does not comply with the Tres Alamos Area Plan which states, "... the Tres Alamos communities will maintain a rural quality characterized by quiet, peacefulness, neighborliness, the beauty of the rural environment and large lot sizes.' "

Turisk states, "If approved, the applicant has proposed maintaining all dogs during non-daylight hours in an indoor facility upon build-out of the project ... This is an especially important component because several area residents complained about excessive barking at the public hearing in November 2008 and via written correspondence ..."

Turisk also points out that the department's recommendation of denial is based on seven factors, including the accusation by Cochise County Animal Control Officer Laurie Fivecoat that Beal has failed to comply with county codes on animal vaccination requirements and the uncertainty that Beal's mitigation methods would ensure compliance with the peace and quiet provision of the area plan.

The meeting of the Planning and Zoning Commission will be held at 4 p.m. today in the Board of Supervisors meeting room at the Melody Lane complex in Bisbee.
